    Cosco-owned US trucker ordered by court to see drivers as employees

    NEW JERSEY's Intermodal Bridge Transport (IBT), a Cosco-owned trucker for Target and Amazon, has been ordered by an Administrative Law Court judge to stop misclassifying its harbour truckers as independent contractors and recognise them as employees.

    Judge Dickie Montemayor upheld the Teamsters union view that IBT's "misclassifying employees as independent contractors" is an "unfair labour practice" and a violation of their rights under the National Labour Relations Act, reported American Shipper.

    The Teamsters first sued IBT in 2015, saying the company was trying to stop drivers from gaining employee status to stop unionisation, also accusing the employer of threatening pro-union drivers with unspecified reprisals.

    The ruling followed a string of strikes by drivers at IBT, legal claims for wage theft and a class action lawsuit, mostly organised by the Teamsters.

    IBT, which is a subsidiary of Chinese state-owned Cosco Group, has operations across the US, including at the Los Angeles, Long Beach and New York-New Jersey seaports. Its main customers include Target, General Electric, Trek Bicycle, Sony and Amazon.
